Breaking: Judge Rules Against Obama Administration on Gulf Drilling Moratorium

A federal judge in New Orleans has lifted the Obama Administration’s six month moratorium on offshore oil drilling. U.S. District Judge Martin Feldman said in his ruling that the Interior Department failed to provide adequate reasoning for the moratorium:

A New Orleans federal judge lifted the six-month moratorium on deepwater drilling imposed by President Barack Obama following the largest oil spill in U.S. history. Shares of drilling services companies jumped on the news.

Obama temporarily halted all drilling in waters deeper than 500 feet on May 27 to give a presidential commission time to study improvements in the safety of offshore operations. More than a dozen Louisiana offshore service and supply companies sued U.S. regulators to lift the ban.

U.S. District Judge Martin Feldman today granted a preliminary injunction, halting the moratorium. Government lawyers told Feldman that ban was based on findings in a U.S. report following the sinking of the Deepwater Horizon rig off the Louisiana coast in April.

“The court is unable to divine or fathom a relationship between the findings and the immense scope of the moratorium,” Feldman said in his 22-page decision. “The blanket moratorium, with no parameters, seems to assume that because one rig failed and although no one yet fully knows why, all companies and rigs drilling new wells over 500 feet also universally present an imminent danger.”

Don’t start celebrating just yet, White House Press Secretary Robert Gibbs said the administration would immediately appeal the decision to the 5th Circuit.

Bottom line, Judge Feldman’s ruling is victory for common sense and the rule of law that will hopefully be upheld by the 5th Circuit.

The Obama Administration’s six month moratorium was ill-conceived  from the start. The seven experts who advised President Obama on offshore drilling safety after the Deepwater Horizon explosion have all gone on record accusing the administration of misrepresenting their views to make it appear they supported a six-month drilling moratorium — something they actually oppose… and something Judge Feldman hones in on in his ruling (PDF):

In the Executive Summary to the Report, the Secretary [Salazar] recommends “a six-month moratorium on permits for new wells being drilled using floating rigs.” He also recommends “an immediate halt to drilling operations on the 33 permitted wells, not including relief wells currently being drilled by BP, that are currently being drilled using floating rigs in the Gulf of Mexico.”

Much to the government’s discomfort and this Court’s uneasiness, the Summary also states that “the recommendations contained in this report have been peer-reviewed by seven experts identified by the National Academy of Engineering.” As the plaintiffs, and the experts themselves, pointedly observe, this statement was misleading. The experts charge it was a “misrepresentation.” It was factually incorrect. Although the experts agreed with the safety recommendations contained in the body of the main Report, five of the National Academy experts and three of the other experts have publicly stated that they “do not agree with the six month blanket moratorium” on floating drilling.

Update (Wednesday, June 23, 2010): The AP is reporting Interior Secretary Ken Salazar intends to issue a new order imposing a moratorium on deepwater drilling in a few days. The report claims Sec. Salazar’s new order will include additional information making clear why the government believes the six-month drilling is necessary.

Rep. John Murtha, Pennsylvania Democrat, Dies at 77

Reuters is reporting that Congressman John “Jack” Murtha of Pennsylvania has passed away:

Democratic Representative John Murtha, the chairman of the House of Representatives defense appropriations subcommittee who exercised enormous influence on defense issues, died on Monday.

Murtha, 77, died peacefully at Virginia Hospital Center in Arlington with his family by his side, a statement from his office said. He had been hospitalized recently with a gallbladder problem.

As the top Democrat on the House panel that oversaw defense appropriations, Murtha wielded big clout in Congress, making decisions affecting billions of dollars in defense-related spending.

The Pennsylvanian was first elected to the U.S. House of Representatives in February 1974. He was a former Marine and veteran of the Vietnam war.

It’s bad form to speak ill of the dead so I’ll just say, Godspeed Congressman, rest in peace.

Breaking: Four Police Officers Shot Near McChord Air Force Base in Parkland, Wash.

Details are still sketchy, but KING TV in Seattle is reporting that four police officers where shot and killed near McChord Air Force Base in Parkland, Washington:

Four police officers have been shot and killed near McChord Air Force Base.

Pierce County Sheriff’s spokesman Ed Troyer says that the officers were in a coffee shop near 116th Street and Steele Street on the east side of the Air Force base at about 8:30 a.m.

The officers were reportedly preparing for their shift when they were ambushed by an unknown number of assailants.

Our thoughts and prayers go out to the families of the officers involved and to the members of the Pierce County Sheriff’s Department.

Update (10:25 p.m.): KING TV is reporting that police have identified a person of interest in the killings of four Lakewood police officers:

Pierce county sheriff’s spokesman Ed Troyer said they are looking for Maurice Clemmons, 37.

Troyer said Clemmons has an extensive violent criminal history from Arkansas, including aggravated robbery and theft. He has also recently been arrested and charged in Pierce County for assault on a police officer and for rape of a child.

Troyer said Clemmons is one of several people investigators would like to talk to and can’t be called a suspect at this point.

Lakewood Police Chief Bret Farrar identified the four officers who were killed as Sergeant Mark Renninger, and Officers Ronald Owens, Tina Griswold, and Greg Richards. All were veteran police officers with families.

Update (11:00 p.m.): The Seattle Times is reporting that then Arkansas Gov. Mike Huckabee granted clemency to Maurice Clemmons nine years ago:

Maurice Clemmons, the 37-year-old Tacoma man being sought for questioning in the killing this morning of four Lakewood police officers, has a long criminal record punctuated by violence, erratic behavior and concerns about his mental health.

Nine years ago, then-Arkansas Gov. Mike Huckabee granted clemency to Clemmons, commuting his lengthy prison sentence over the protests of prosecutors.

“This is the day I’ve been dreading for a long time,” Larry Jegley, prosecuting attorney for Arkansas’ Pulaski County said tonight when informed that Clemmons was being sought for questioning in connection with the killings.

Clemmons’ criminal history includes at least five felony convictions in Arkansas and at least eight felony charges in Washington. The record also stands out for the number of times he has been released from custody despite questions about the danger he posed.

I’ve never been a Huckabee fan and after this I wouldn’t give him the time of day!

Update (Wednesday, December 2, 2009): Maurice Clemmons, the man wanted in connection with the killings of four Lakewood, Washington police officers on Sunday was shot and killed by a police in south Seattle on Tuesday:

A man accused of gunning down four police officers was shot and killed by authorities on Tuesday in a case that could affect a potential 2012 U.S. presidential candidate who granted him clemency in the past.

Maurice Clemmons, wanted in the Sunday morning fatal shootings of four officers in a coffee shop near Tacoma, Washington, was shot dead by a police officer in south Seattle, the Pierce County Sheriff’s Department said.

I suspect police would have preferred a different outcome but I doubt anyone is going to be shedding a tear of Clemmon’s passing.

Breaking: Golfer Tiger Woods Injured in Car Crash

Details about the incident are still sketchy, but he’s probably the best known professional athlete in the world and it’s painfully slow news day:

Professional golfer Tiger Woods suffered “serious” injuries during a car crash near his Windermere, Fla., home early this morning, according to the Florida Highway Patrol

The 33-year-old Woods was driving a 2009 Cadillac SUV alone when he hit a fire hydrant and then slammed into a tree on Deacon Circle at 2:25 a.m., according to police reports.

Woods was taken to Health Central Hospital in Ococee.

Investigators said alcohol was not involved, but they did not know yet what caused the crash.

Charges are pending.

Update (3:50 p.m.): Reuters is reporting that Mr. Woods has been released from the hospital:

Golfer Tiger Woods has been released from hospital after being injured in a car accident in Florida on Friday, a local Florida mayor told CNN.

Windermere Mayor Gary Bruhn said he believed Woods had been released. “Basically it was facial lacerations, and as I’m understanding it, nothing that serious,” Bruhn said.

At this point we know very little about what actually happened all we have to go on is confusing and/or conflicting media reports and idle speculation on blogs and talk radio. Based on everything I’ve read so far I suspect this going to turn out to be much to do about very little.

It appears that contrary to early reports the accident and Mr. Woods injuries were fairly minor, time will tell, but I suspect this going to turn out to be nothing more than a minor traffic accident.

Update (6:50 p.m.): The following statement was released by Health Central Hospital and Tiger’s Woods’ office earlier this evening:

Tiger Woods was in a minor car accident outside his home last night.

He was admitted, treated and released today in good condition.

Breaking: Fort Hood Gunman Alive, in Custody

From Fox News:

A military doctor who reportedly feared an impending war deployment is in custody as the sole suspect in a shooting rampage at the Army’s Fort Hood that left 12 dead and 31 wounded, an Army official said Thursday night.

The news that the suspect, Major Nidal Malik Hasan, was alive and in stable condition, came as a sudden reversal of early reports that the gunman was among the dead.

Two other soldiers who were taken into custody as possible suspects were released Lt. Gen. Bob Cone told reporters Thursday evening.

A female first responder who shot at Hasan who was previously thought to be dead, was also alive.

The Fox News report goes on to say that Hasan first came to the attention of Federal Officials were apparently still trying to determine if he was the author of those posts and an official investigation had not been opened.

According the Washington Post Hasan was a devout Muslim who attended service regularly:

Hasan attended the Muslim Community Center in Silver Spring and was “very devout,” according to Faizul Khan, a former imam at the center. Khan said Hasan attended prayers at least once a day, seven days a week, often in his Army fatigues.

Khan also said Hasan applied to an annual matrimonial seminar that matches Muslims looking for spouses. “I don’t think he ever had a match, because he had too many conditions,” Khan said.

“We never got into details of worldly affairs or politics,” the former imam said of his conversations with Hasan. “Mostly religious questions. But there was nothing extremist in his questions. He never showed any frustration. . . . He never showed any . . . wish for vengeance on anybody.”

I’m not going to speculate on Hasan’s possible motives for a variety of reasons… Suffices to say I’m not buying the media’s Post Traumatic Stress Disorder spin. At first blush the circumstantial evidence appears to in very disturbing direction, and it raises a number of questions that need to be answered, but I don’t think it’s appropriate for us to start jumping to conclusions about Hasan’s motives based on incomplete or inaccurate information. Lets give investigators time do their jobs, I’m sure they’re have answers to all our questions in do course.

Breaking: 12 Dead, 31 Wounded in Shooting at Fort Hood

From Reuters:

Twelve people were killed and at least 31 were wounded when a soldier went on a shooting rampage at the Fort Hood U.S. Army base at Fort Hood Texas on Thursday, base commander Lieutenant-General Bob Cone said.

Cone told reporters at the base that the gunman was killed in the attack at the facility, the biggest military base in the world and a prime point of deployment for U.S. operations in Iraq and Afghanistan.

Two other soldiers were apprehended as suspects.

Cone said the shooting took place at a “Soldier Readiness Facility” where soldiers preparing for overseas deployment were getting last-minute medical checkups. The shooting took place at about 1:30 p.m. CST.

“The shooter was killed. He was a soldier. We since then have apprehended two additional soldiers that are suspects. There were eyewitness accounts that there may have been more than one shooter,” Cone said .

ABC News is reporting the shooter has been identified as Major Nidal Malik Hasan, a convert to Islam:

The suspected gunman was identified by ABC News as Major Nidal Malik Hasan.

The shooter was killed and two other suspects, who are also soldiers, have been apprehended, Lt. Gen. Robert W. Cone said.

The gunman reportedly used two handguns.

Update (6:15 p.m.): CBS News is reporting that Maj. Hasan, 39, was a a licensed psychiatrist from Silver Spring, Md. He was apparently scheduled to deploy to Iraq and was upset about it.

Update (6:50 p.m.): The Austin American-Statesman is reporting that the two suspects arrested shortly after the shooting have apparently been  released. The Statesman also points to an AP report questioning what Hasan’s religion was or whether he was a convert.

Update ( 7:30 p.m.): The guys over at This ain’t Hell have some how gotten their hands on a copy of Hasan’s ORB… Contrary to media reports he’s never been deployed overseas. I guess that blows the PTSD theory out of the water…

Washington Times: ACORN Says Workers Conduct ‘Indefensible’

The Washington Times is reporting that ACORN, the Association of Community Organizations for Reform Now, is suspending advising new clients as part of its service programs and is setting up an independent review to investigate what happened:

ACORN, calling the actions of some of its employees “indefensible,” has suspended advising new clients as part of its service programs and is setting up an independent review to see what happened.

ACORN chief executive Bertha Lewis said in a written statement that she was “ordering a halt to any new intakes into ACORN’s service programs until completion of an independent review.”

The actions were taken, she said, “as a result of indefensible action of a handful of our employees.”

Videos of ACORN workers giving tax advice to people posing as prostitutes and other revelations have led to growing criticism of the organization in recent days.

Lewis continued: “We have all been deeply disturbed by what weve seen in some of these videos. I must say, on behalf of ACORN’s Board and our Advisory Council, that we will go to whatever lengths necessary to reestablish the public trust. For nearly forty years, ACORN has given voice to communities, and gotten results. Right now, our nearly 500,000 member are working their hearts out for quality, affordable healthcare for every American and to help stop the foreclosure crisis. We must get this process right, so the good work can go forward.”

ACORN, an advocacy group, has fired at least four employees after hidden camera videos showed the group’s workers giving financial advice to women posing as prostitutes. The firings occurred in the group’s Washington and Baltimore offices.

I haven’t been following the ACORN story closely, but it suffices to say were there’s smoke there’s fire. The simple fact that ACORN has apparently fired at least four employees and is taking the steps announced today would seem to confirm what James O’Keefe and Hannah Giles uncovered.

My guess is that the independent review will ultimately find that actions documented O’Keefe and Giles were the work of rouge employees and not the result of institutional problems.

Breaking: New York Residences Raided in Terrorism Probe

Not a lot of details yet but the Associated Press is reporting that law enforcement agents have conducted raids related to a terrorism investigation in New York City:

Law enforcement agents raided residences in New York City on Monday as part of a terrorism investigation, and began briefing Congress about the probe.

New York Police Department spokesman Paul Browne confirmed that searches were conducted in the borough of Queens by agents of a joint terrorism task force. He would not discuss the matter further.

Separately, federal authorities started briefing a series of senior lawmakers in Congress about the case.

CBSNews adds a few additional details but information is still sketch at this point.

WCBS TV’s John Slattery reports the federal search warrant spelled out all manner of possible bomb-making components, including powders, gels, TNT, and fuses.

Building resident Assad Niazi told WCBS, “I don’t know [the other residents]. They are roommates – they go to work in the morning, and at night they come back.”

Update (8:45 p.m.): Reuters is reporting that the NYPD and FBI raided at least apartments in Queens early this morning one of which was shared by five Afghan men:

New York City police and the FBI raided homes in the borough of Queens early on Monday as part of an investigation into suspected terrorism, focusing on one man who has been under surveillance, officials said.

Authorities searched at least two apartments including one shared by five Afghan men, taking some of them in for questioning, said one man who was questioned.

Members of U.S. Congress briefed by the Federal Bureau of Investigation said there was no imminent danger.

“There was nothing imminent, and they are very good now at tracking potentially dangerous actions and this was preventive,” said Charles Schumer, a U.S. Senator from New York who was among those briefed by FBI officials.

A man who identified himself as Amanullah Akbar, a 30-year-old taxi driver, said the FBI raided the apartment he shares with four other Afghan men at 2:30 a.m. (1630 GMT)

He was brought in for questioning and released and said he had no idea why his home was targeted, adding that he believed one of his roommates was arrested.

According to news reports the focus appears to be on one man who was being watched, authorities grew concerned as he met with people in Queens over the weekend and applied for search warrants late yesterday… The agents were apparently searching for all manner of possible bomb-making components, including powders, gels, TNT, and fuses.

Update II (9:10 p.m.): The Wall Street Journal is reporting that the individual at the center of the investigation may have been trying to obtain materials that could have been used in making a chemical, biological or radiological device:

Authorities executed search warrants and seized evidence early Monday morning at locations in the Queens borough of New York City as part of a terrorism investigation, according to a senior official familiar with the case.

This person said some counterterrorism officials were concerned that the individual at the center of the investigation may have had access to, or an interest in acquiring, materials that could be used for a chemical, biological or radiological device. One aspect of the probe involves whether the person had some contact or connections with suspicious individuals overseas, the official said. He stressed that the investigation was still at its earliest stages.

No wonder they were briefing Congress.

Breaking: Sarah Palin Resigning as Governor of Alaska

Alaska Governor Sarah Palin announced today that she will resign from office July 26. Palin made the announcement from her home in Wasilla, she was flanked by her husband, Todd, her family and state commissioners. Lt. Gov. Sean Parnell will succeed her.

Wow, this is a bit of a shocker… The only question is where does she go from here? I tend to agree with Jim Geraghty, her national political career is over. You can’t resign from a governorship you’ve held for roughly 30 months and then run for President.

Update II (5:45 p.m.): MSNBC’s Andrea Mitchell claims sources close to Gov. Palin have told her that Palin’s “had it” with national politics and told her top backers to go ahead and commit to other candidates for 2012. Real Clear Politics has the video here.

Given the source I’m taking that report with a grain of salt… To be honest, though, it wouldn’t surprise me in the least if Mitchell’s report turns out to true. Sarah Palin has been beaten senseless by the media and her family has been dragged through the mud. Why would any sane person want to subject herself and her family to the kind treatment Palin has endured?

Update III (9:35 p.m.): I’ve been without power for the last three hours so I’m playing catch up here… First, Mike Allen at the Politico is reporting that Palin plans to remain “extremely visible and will give serious consideration to running for president in 2012.”

Second, Ed Morrissey at Hot Air points out an interview Palin did with John Ziegler last month and wonders if Gov. Palin hinted at quitting last month?

I’m not sure what to make of Gov. Palin’s decision, my gut feeling is she’s done with elective politics. I suspect she’ll remain an active and visible champion for conservative principle through speaking engagements and by campaigning for other candidates but I doubt she’ll ever run for office again.

Breaking: Two Shot Inside Holocaust Museum

A gunman opened fire in the lobby of the Holocaust Museum in Washington D.C., wounding a security guard before other officers returned fire.

Fox News reports that gunman has been identified as 88 year old James Von Brunn:

The gunman has been identified as James Von Brunn, FOX News has learned, a man with apparent links to the white supremacist movement. A Web site believed to be his personal blog carries several anti-Semitic statements — the site says he was a World War II veteran and also served time in federal prison for trying to make a “citizens arrest” of Federal Reserve Board members in 1981.

David Schlosser, a spokesman for the U.S. Park Police, said two people were shot Wednesday  – the security guard and the gunman. Both were transferred to a local hospital, he said.

Schlosser said the gunman entered the museum shortly before 1 p.m. ET carrying a “long gun,” but that it’s unclear whether he was carrying a rifle or a shotgun. He shot one security guard, Schlosser said, and then two other security guards returned fire, wounding the shooter.

There were conflicting reports about how many people were wounded. Another law enforcement official earlier said three people were shot, though there are no fatalities.

“The scene is secure,” the source said.

Police and other law enforcement, including the FBI’s Terrorism Task Force, have surrounded the museum site.

Update (6:49 p.m.): Stephen T. Johns, 39, the special  police officer wounded by National Holocaust Museum shooting suspect James Von Brunn has died of his wounds. My heart goes out Officer Johns friends, family and colleagues… You are in my thoughts and prayers.
