Dept. of Homeland Security Secretary Janet Napolitano is without a doubt the biggest idiot in Washington. Her remarks<\/a> on CNN’s State of the Union on Sunday demonstrates she has no clue about the laws her agency is supposed to enforce:<\/p>\n

KING: A lot of Democrats in Congress want to you investigate [Joe Arpaio]. They think he is over the line. He says he is just enforcing the law and the problem is the federal government.<\/p>\n

NAPOLITANO: Well, you know, Sheriff Joe, he is being very political in that statement, because he knows that there aren\u2019t enough law enforcement officers, courtrooms or jail cells in the world to do what he is saying.<\/p>\n

What we have to do is target the real evil-doers in this business, the employers who consistently hire illegal labor, the human traffickers who are exploiting human misery.<\/p>\n

And yes, when we find illegal workers, yes, appropriate action, some of which is criminal, most of that is civil, because crossing the border is not a crime per se<\/strong>. It is civil. But anyway, going after those as well.<\/p><\/blockquote>\n

Excuse me??? With all due respect madam secretary you might want to review 8 USC Sec. 1325<\/a>:<\/p>\n

(a) Improper time or place; avoidance of examination or inspection;
\nmisrepresentation and concealment of facts
\nAny alien who (1) enters or attempts to enter the United States
\nat any time or place other than as designated by immigration
\nofficers, or (2) eludes examination or inspection by immigration
\nofficers, or (3) attempts to enter or obtains entry to the United
\nStates by a willfully false or misleading representation or the
\nwillful concealment of a material fact, shall, for the first
\ncommission of any such offense, be fined under title 18 or
\nimprisoned not more than 6 months, or both, and, for a subsequent
\ncommission of any such offense, be fined under title 18, or
\nimprisoned not more than 2 years, or both.
\n(b) Improper time or place; civil penalties
\nAny alien who is apprehended while entering (or attempting to
\nenter) the United States at a time or place other than as
\ndesignated by immigration officers shall be subject to a civil
\npenalty of –
\n(1) at least $50 and not more than $250 for each such entry (or
\nattempted entry); or
\n(2) twice the amount specified in paragraph (1) in the case of
\nan alien who has been previously subject to a civil penalty under
\nthis subsection.
\nCivil penalties under this subsection are in addition to, and not
\nin lieu of, any criminal or other civil penalties that may be
\nimposed.
\n(c) Marriage fraud
\nAny individual who knowingly enters into a marriage for the
\npurpose of evading any provision of the immigration laws shall be
\nimprisoned for not more than 5 years, or fined not more than
\n$250,000, or both.
\n(d) Immigration-related entrepreneurship fraud
\nAny individual who knowingly establishes a commercial enterprise
\nfor the purpose of evading any provision of the immigration laws
\nshall be imprisoned for not more than 5 years, fined in accordance
\nwith title 18, or both.<\/p><\/blockquote>\n

Call me crazy but shouldn’t the Secretary of Homeland Security know that illegal immigration is a crime?<\/p>\n

Unfortunately, I suspect Sec. Napolitano knows all to well what the law is, and like administration she serves, has chosen not to actively enforce it.<\/p>\n
