{"id":1536,"date":"2009-02-18T14:34:26","date_gmt":"2009-02-18T19:34:26","guid":{"rendered":"http:\/\/www.jasetaro.com\/blog\/?p=1536"},"modified":"2009-02-18T14:34:26","modified_gmt":"2009-02-18T19:34:26","slug":"healthcare-provisions-of-stimulus-law-not-well-understood","status":"publish","type":"post","link":"https:\/\/www.jasetaro.com\/blog\/2009\/02\/18\/healthcare-provisions-of-stimulus-law-not-well-understood\/","title":{"rendered":"Healthcare Provisions of Stimulus Law Not Well Understood"},"content":{"rendered":"<p>CNSNews.com has two must read pieces on the stimulus laws healthcare provisions&#8230; The first deals with the plans <a href=\"http:\/\/www.cnsnews.com\/public\/content\/article.aspx?RsrcID=43631\" target=\"_blank\">National Medical Records System provisions<\/a>:<\/p>\n<blockquote>\n<h3>Stimulus Law Does Not Require All Americans to Enter Their Medical Records into National System, Dems Say<\/h3>\n<p>By Josiah Ryan, Staff Writer, CNSNews.com, Tuesday, February 17, 2009<\/p>\n<p>Two top House Democrats told CNSNews.com on Friday that a section\u00a0in the $787-billion economic stimulus bill that requires the creation of \u201celectronic health records for each person in the United States by 2014\u201d does not mean that the\u00a0medical records of every American must be included in the\u00a0new national infrastructure.<\/p>\n<p>In the bill, which passed both chambers of Congress on Friday\u00a0and which President Obama is scheduled to sign Tuesday,\u00a0$3 billion is allocated for a \u201cNational Coordinator for Health Information Technology\u201d to create and meet the objectives of a strategic plan to build a national infrastructure of \u201celectronic health records for each person in the United States by 2014.\u201d<\/p>\n<p>House Energy and Commerce Chairman Henry Waxman (D-Calif.) and\u00a0House Health Subcommittee Chairman\u00a0Frank Pallone Jr. (D-N.J.) both told CNSNews.com on Friday that they do not think the law mandates that every American\u2019s health care records must\u00a0be entered into the national system.<\/p><\/blockquote>\n<p>The second deals with exceptions in the law that could make it easier to <a href=\"http:\/\/www.cnsnews.com\/public\/content\/article.aspx?RsrcID=43624\" target=\"_blank\">sell medical records<\/a>:<\/p>\n<blockquote>\n<h3>\u2018Exceptions\u2019 in Stimulus Bill Allow Sale of Health Records<\/h3>\n<p>By Fred Lucas, Staff Writer, CNSNews.com, Tuesday, February 17, 2009<\/p>\n<p>(CNSNews.com) \u2013 It could become easier to sell and exchange the health information of Americans under the economic stimulus package that awaits President Barack Obama\u2019s signature Tuesday.<\/p>\n<p>The $787 billion American Recovery and Reinvestment Act that passed Congress last week allocates $19 billion to establish centrally linked health data infrastructure to contain the health information of \u201ceach American\u201d by 2014 and to set up the new office of the \u201cNational Coordinator for Health Information Technology.\u201d<\/p>\n<p>Though the legislation says there is a \u201cprohibition on sale of electronic health records or protected health information,\u201d there are five pages of exceptions to the prohibition that include research, treatment of an individual, or a decision by the Secretary of Health and Human Services to waive the prohibition.<\/p><\/blockquote>\n<p>While the stimulus law&#8217;s healthcare provisions are worrying in and of themselves, the bigger concern is that this law was\u00a0 rushed through congress without any of the normal committee markups and debate. No one seems to know what&#8217;s in it.
